Skillers.Pk (Powered by Webicosoft Priviate Limited) is an online networking community that connects its members through a variety of services that it provides to its members. This document covers the terms and conditions under which these services are provided.

• Your registration as a member of Skillers.Pk or the use of any of the features and services on Skillers.Pk, either as a registered member or as a visitor constitutes automatic acceptance of these terms and conditions.
• Skillers.Pk reserves the right to update the terms, conditions and notices of this agreement without notice to you. It is your responsibility to periodically review the most current version of this Agreement.
• By accessing or using the Sites, Content, or Services, you agree to be bound by these Terms of Service.
• If you do not agree with any of the terms and conditions of Skillers.Pk, do not register and you will not be authorized to use Skillers.Pk services.
• The views expressed on the website are not those of Skillers.Pk, and any issues in them belong to the respective contributors.
• Through the use of this site, you agree to hold Skillers.Pk harmless and its sponsors, owners, shareholders or employees against any claims.
• You are responsible for safeguarding the password that you use to access the Sites, Content and Services. You agree not to disclose your password to any third party. You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions.
• You may not make any content item originating from Skillers.Pk available for public access by any means whatsoever without obtaining prior written permission from Skillers.Pk.
• Skillers.Pk provides a variety of forums for its members to express themselves in the form of blogs, comments, reviews and photographs. You truthfully assert that the content being contributed is yours and that you own the copyright to the content.
• The content on the website is posted by Skillers.Pk, visitors and its members. Skillers.Pk will attempt to ensure the integrity and the accuracy of the Site in the Content and or Services but it does not guarantee that the information is accurate or complete or current. Skillers.Pk can not be held liable for inaccuracy of any data listed on the website or any damage caused by the use of inaccurate data. It is Skillers.Pk’s policy to correct any inaccuracy reported within 7 days.
• The opinions and reviews expressed on the site belong to the users and Skillers.Pk cannot be held liable in any way about the content of the opinions and reviews. The platform allows users to express their views about different schools, teachers and training centers.
• Information about the schools posted on the site is obtained from their official websites, other source on the internet and in some cases by calling the schools.
• Skillers.Pk should not be thought of as the authority and the final guide in your decision making.
• Skillers.Pk at its sole discretion may edit, delete or block access to any Content including Member Posted Content, without notice and without liability. We will however make reasonable efforts to inform you of the changes.
• By uploading the logo of your institute, you give Skillers.Pk the right to use the logo on Skillers.Pk website as well as on any Skillers.Pk marketing material.
• If you are a visitor on our website and if you update any personal contact information such as phone number or e-mail address, Skillers.Pk reserves the right to contact you over Phone calls, SMS or E-mail. If the intention was for Mentoring/learning, or seeking information about our product & services, Skillers.Pk team will guide you accordingly via phone call, SMS or e-mail.

While using the web site and engaged in any form of communication on any of the forums, you agree not to:

• Post, publish or transmit any messages that is false, misleading, defamatory, harmful, threatening, abusive, harassing, defamatory, invades another’s privacy, offensive, promotes racism, hatred or harm against any individual or group or religion or caste, infringes another’s rights including any intellectual property rights or copyright or trademark, violates or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability.
• Upload or post otherwise make available any content that you do not have a right to make available, under any law or under contractual or fiduciary relationships.
• Upload or post or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party. You may, however, post excerpts of copyrighted material so long as they adhere to Fair Use guidelines.
• Collect screen names and email addresses of members for purposes of advertisement, solicitation or spam are prohibited.
• Skillers.Pk doesn’t allow registration for Home Tuition Agencies & Organizations who are engaged in providing products or services similar to that of Skillers.Pk (or) who is engaged in collection of data from Skillers.Pk website and sharing/utilizing it for the benefit of competitors. If there are any such registrations, Skillers.Pk reserves the right to terminate those accounts without any prior notice & without processing the refund of subscription associated to those accounts. Skillers.Pk also reserves the right to initiate any legal proceedings if any ‘Home Tuition Agencies or Organizations’ contravenes condition as stated above.
• Kindly clarify your doubts before you make a payment to upgrade to any of our premium membership plans or buy extra coins. Once a payment is made, it cannot be refunded.
• Before availing any of our advertising packages – Sponsored Listing, Branding Package and Banner Ad, kindly understand the benefits the packages offer. The payment made for any of our Branding packages is non-refundable.
• In case you have any doubt or query, please drop an email at support@Skillers.Pk . We’ll get back to you within 2 working days.
• Attempt to probe, scan, or test the vulnerability of website or breach any security or authentication measures.
• Access or search the Sites Content or Services with any engine, software, or tool.
• Send unsolicited email, junk mail, spam, or chain letters, or promotions or advertisements for products or services.
• Reformat or frame any portion of the web pages that are part of the Skillers.Pk Site without a written agreement.
• Create user accounts by automated means or under false or fraudulent pretenses.
• Post text, messages, graphics or materials that are sales offers, advertisements, or promotions for products or services.
• Skillers.Pk reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services with or without notice.

For Skillers.Pk ‘Assured’ Mentors

• All Mentors who are receiving enquiries from Skillers.Pk in categories that have been marked as ‘Skillers.Pk Assured’ categories will be considered as ‘Skillers.Pk Assured’ Mentors once their application for membership is accepted and approved by Skillers.Pk. Following terms will be deemed as accepted by you, if you register yourself as an ‘Skillers.Pk Assured’ Mentor or if you respond (via call, message or booking a demo) to any enquiry in an ‘Skillers.Pk Assured’ category.
• Categories will be designated as ‘Skillers.Pk Assured’ categories for ‘online’ or ‘offline’ (tuitions conducted at student’s home, Mentor’s home or tuition centres) – via email communication. The same will be conveyed on Skillers.Pk website if the Mentor signs up for any such category. In any case, the decision of Skillers.Pk team regarding the categories of enquiries that qualify as ‘Skillers.Pk Assured’ will be considered as final and binding.
• If you have applied for ‘Assured’ membership, your application will need to be accepted and approved by Skillers.Pk, before you can be confirmed as an ‘Skillers.Pk Assured’ Mentor.
• Benefits of being an Skillers.Pk Assured Mentor:
  • You will be charged Skillers.Pk coins for every enquiry you respond to, but you will not lose Skillers.Pk coins if you call someone and the call does not get picked up (after at least 3 attempts)
  • Your Skillers.Pk coins will never expire
  • You will get bonus Skillers.Pk coins as an incentive for getting payments from students who posted an enquiry on Skillers.Pk
• Coins will get auto-refunded if the following scenarios apply:
  • If it is a general enquiry posted by a Student.
    • You can choose to respond to this enquiry by spending Skillers.Pk Coins. Only 5 Mentors are allowed to contact such enquiry. The coins you spent, can be refunded only if ALL the following conditions are met:
      • Your message was not read by the Student within 48 hours
      • You tried calling the Student at least 3 times over the 48 hours, and the call was never picked up, and the student also didn’t call back.
      • You have not sent a request payment link.
    • If the student turned out to “not” be interested when you spoke, that is not the reason for a refund. Expect that there would be certain cases where Students enquired, verified their number via OTP and then dropped the plan. We have taken this into consideration, when deciding the Coins pricing for each category.
  • If the student sends a direct message to the Mentor.
    • Your coins are deducted when this message is received.
    • The coins that are deducted, can be refunded only if ALL the following conditions are met:
      • If you sent a response message, it was not read by the Student within 48 hours
      • You tried calling the Student at least 3 times before the demo, and the call was never picked up, and the student also didn’t call back.
      • This Student didn’t show up for the demo for the first 10 minutes of scheduled time.
      • You have not sent a request payment link.
  • If the Student books a demo with the Mentor
    • Your coins are deducted when the demo is booked. You may also receive any message sent by the Student while booking the demo. You can choose to respond to the message or call the Student.
    • The coins that are deducted, can be refunded only if ALL the following conditions are met:
      • If you sent a response message, it was not read by the Student within 48 hours
      • You tried calling the Student at least 3 times before the demo, and the call was never picked up, and the student also didn’t call back.
      • This Student didn’t show up for the demo for the first 10 minutes of scheduled time.
      • You have not sent a request payment link.
    • If you reject a demo without trying to call Student at least 3 times, your coins are not refunded.
• Transaction Fees as chargeable to Skillers.Pk Assured Mentors:
  • For First Transaction by a student to any Mentor, Rs. 1200 or FLAT 20% Transaction Fee will be applied, whichever is higher
  • For Repeat Transactions too by the same student to the same Mentor, 20% Transaction Fee will be applied
  • The Transaction Fee mentioned above is subject to change from time to time at the sole discretion of management at Skillers.Pk
• Bonus Coins for Skillers.Pk Assured Mentors:
  • You will receive bonus coins for every payment that you receive from a learner via Skillers.Pk SecurePay. Your bonus coins will be equal to the transaction fee that you pay to Skillers.Pk for the payment received via Skillers.Pk SecurePay. For example, if you collect payment of Rs 6000 from a learner and you pay a transaction fee of 20% (i.e. Rs 1200) then you will receive 1200 Bonus Coins as well.
  • The policy for awarding bonus coins as mentioned above is subject to change from time to time at the sole discretion of management at Skillers.Pk
• Terms of communication with students and receiving payments from students or learners who posted an enquiry on Skillers.Pk
  • As an Skillers.Pk Assured Mentor, you are required to share only the ‘Skillers.Pk SecurePay’ link with learners who want to make a payment to you for any of the classes they agree to take up with you.
  • As an Skillers.Pk Assured Mentor, you are required to communicate with learners who posted an enquiry on Skillers.Pk, only by using the messaging, call or demo options offered through Skillers.Pk.
  • As an Skillers.Pk Assured Mentor, you should not miss any demo booked with you by learners.
  • For any demo booked with you, you will have an option to reject it up to 3 hours in advance of the scheduled time. You may also update your availability calendar – in order to avoid getting demos booked in time slots that you are not comfortable with.
  • For any demo booked with you, there is a penalty equal to the Coins charged for such demos if you miss these demos without cancelling or rejecting them explicitly at least 3 hours in advance.
• Terms of suspension from the Skillers.Pk Assured membership:
  • Skillers.Pk reserves the right to suspend you from Skillers.Pk Assured membership for a period which may last for a few days, months or even permanently, at the sole discretion of management at Skillers.Pk, if you are found to be indulging in any of the following activities:
    • Sharing your contact information with students via messaging, a call or a demo session conducted through Skillers.Pk. Including any contact information that can potentially take the conversation and the student outside of Skillers.Pk, will be considered as a policy violation that may invite a suspension.
    • Sharing any information, link or any message that can be used by the student to make a payment to you, without using Skillers.Pk SecurePay link, will be considered as a policy violation that may invite a suspension.
    • Any failure to report students (within 24 hours of the incident happening) who either share their contact information or try to transfer payments without using Skillers.Pk SecurePay link, will also be considered as a policy violation that may invite a suspension.
    • In order to ensure compliance, all conversations in the form of messages, virtual calls or demo sessions until the time a student is converted, will be recorded and monitored by our Audit Team and will be considered the intellectual property of Skillers.Pk for all intents and purposes. Once a student is converted (i.e a payment has been made via Skillers.Pk SecurePay for any of your classes), all classes conducted between you and a student, and the content therein – will remain your intellectual property and it will not be used by Skillers.Pk for any purpose without explicit permission from you. The option to record such classes will remain with you at the time of conducting these classes.
    • Once you get a Student from Skillers.Pk, all future payments from this Student must be taken via Skillers.Pk Secure Pay. Any violation of this policy results in a permanent suspension from Skillers.Pk. Skillers.Pk also reserves the right to showcase your profile on the website as a blocked profile, to discourage other Mentors from taking this path.
  • Following will be the duration of suspension for every policy violation against an Skillers.Pk Assured Mentor:
    • 1st violation: Zero days of suspension and a warning to cease & desist from violating the terms of use of ‘Skillers.Pk Assured’ platform
    • 2nd violation: 7 days of suspension and a warning to cease & desist from violating the terms of use of ‘Skillers.Pk Assured’ platform
    • 3rd violation: 30 days of suspension and a warning to cease & desist from violating the terms of use of ‘Skillers.Pk Assured’ platform
    • 4th violation: 90 days of suspension or permanent removal from ‘Skillers.Pk Assured’ platform, at the sole discretion of the management at Skillers.Pk
• Support offered to you as an Skillers.Pk Assured Mentor
  • For the first 14 days or until you get a student, you will be assigned a Partner Success Manager, who will help you get started with the platform.
  • After this time period, you will have access to your support team, which is available on chat from 8am to 10pm on all days.
• Copyright protection for all Training Content uploaded by you on Skillers.Pk
  • Skillers.Pk will not use any Training Content uploaded by you on Skillers.Pk – for any commercial purpose or otherwise without seeking explicit permission from you as and when required
  • Skillers.Pk may request you to upload your training content on Skillers.Pk for the sole reason of making your experience of conducting tuition classes online on Skillers.Pk more seamless and hassle-free
  • By uploading any content on Skillers.Pk, you also warrant that you own the copyright for that content. Any plagiarised content, once noticed by our Audit Team, will be liable to be removed from Skillers.Pk with or without any notice to you.

Venue Only

If you enter into correspondence or engage in commercial transactions with third parties in connection with your use of the Skillers.Pk Service, such activity is solely between you and the applicable third party. Skillers.Pk shall have no liability, obligation or responsibility for any such activity. You hereby release Skillers.Pk from all claims arising from such activity.

Ownership

Except for the Content submitted by members or users, the Skillers.Pk Service and all aspects thereof, including all copyrights, trademarks, and other intellectual property or proprietary rights therein, is owned by Skillers.Pk or its licensors. You acknowledge that the Skillers.Pk and any underlying technology or software used in connection with the Skillers.Pk Service contain Skillers.Pk’s proprietary information. You may not modify, reproduce, distribute, create derivative works of, publicly display or in any way exploit, any of the content, software, and/or materials available on the Skillers.Pk Site, or Skillers.Pk Services in whole or in part except as expressly provided in Skillers.Pk’s policies and procedures. Except as expressly and unambiguously provided herein, Skillers.Pk and its suppliers do not grant you any express or implied rights, and all rights in the Skillers.Pk Service not expressly granted by Skillers.Pk to you are retained by Skillers.Pk.

Limitation of Liability

THE SITE, CONTENT, AND SERVICES ARE PROVIDED AS IS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESSED OR IMPLIED. IN NO EVENT SHALL SKILLERS.PK, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM THE USE OR THE INABILITY TO USE OUR SERVICES.

SKILLERS.PK MAKES NO WARRANTY THAT THE SITES, CONTENT, OR SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

SKILLERS.PK MAKES NO WARRANTY REGARDING THE QUALITY OF ANY PRODUCTS, SERVICES, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR INFORMATION PURCHASED OR OBTAINED THROUGH THE SITES, CONTENT OR SERVICES.
